Pacific Luxe Creative — Luxury Product Photography & Videography (Bali)

Welcome to Pacific Luxe Creative (“PLC,” “we,” “us”). We are a Bali-based studio specializing in high-end product photography, brand films, and campaign content for premium and fashion-forward brands. By using pacificluxecreative.com (the “Site”) or engaging our services (each a “Project”), you agree to these Terms of Service (the “Terms”).
1) Services
1.1 PLC provides luxury product photography and videography including: creative direction, set & prop styling, tabletop and lifestyle scenes, e-commerce imagery, lookbooks, short-form video/reels, and campaign films.
1.2 Optional add-ons: retouching at beauty/cosmetics level, CGI/cleanup, model & HMUA coordination, location & studio rental, set build, product handling, and production management.
1.3 A written Estimate / Scope of Work (SOW) will describe deliverables, usage license, schedule, and fees for each Project. The SOW prevails over any conflicting marketing copy.
2) Booking, Deposits & Payment
2.1 A non-refundable retainer (typically 50%) is required to secure dates and pre-production; no dates are held without payment.
2.2 The balance is due prior to asset delivery (or on agreed milestone dates).
2.3 Accepted payments: bank transfer, major cards via our secure link, or approved online payments. All amounts are quoted in [USD/IDR/AUD] and exclusive of taxes unless stated.
2.4 Late payments may incur 1.5% per month (or the legal maximum) plus collection costs.
3) Client Responsibilities
3.1 Provide a clear brief: brand goals, mood boards, shot list, aspect ratios, usage plans, deadlines, and brand guidelines.
3.2 Products & logistics: Client ships products DDP to our studio and provides return labels; PLC is not liable for customs delays. Uncollected items after 30 days may accrue storage fees or be disposed of.
3.3 Approvals: Client designates a single approver. Feedback windows are set in the SOW; missed windows may shift timelines and incur change fees.
3.4 Releases & compliance: If talent, locations, or third-party IP are required, Client secures necessary permissions unless PLC is contracted to do so.
4) Pricing & Changes
4.1 Rates are based on the approved SOW and include pre-production, shoot time, and the specified standard retouching.
4.2 Change requests (new shots, reshoots not caused by PLC, added props, additional retouching levels, rush delivery) require a written change order and may affect costs and timing.
4.3 Travel & rentals: Studio/location fees, permits, travel, and rentals are billable at cost plus production fee if not included in the SOW.
5) Scheduling, Rescheduling & Cancellations
5.1 Rescheduling by Client with 7+ days’ notice: retainer moves to the new date (once) subject to availability; third-party costs are billable.
5.2 Rescheduling with <7 days’ notice or cancellation: retainer is forfeited and non-recoverable costs are due.
5.3 PLC may reschedule for force majeure (see §12) or illness/equipment failure; new dates will be offered at no additional labor cost.
6) Creative Direction, Styling & Retouching
6.1 Client’s inspiration is welcome; however, artistic style and technical approach remain at PLC’s discretion to achieve a luxury, editorial standard..
6.2 Unless otherwise stated, pricing includes 1 round of creative review and 1 round of retouching revisions per selected image/video. Additional rounds are billed at the then-current rate.
6.3 We do not provide RAW files unless purchased under a separate license.
7) Deliverables & Turnaround
7.1 Proofs/Contact sheets: typically within 3–5 business days after the shoot.
7.2 Final stills: typically within 7–14 business days after selects are approved.
7.3 Video edits/reels: typically within 2–4 weeks after picture-lock and receipt of brand assets (logos, fonts, music license).
7.4 Formats: Print-ready (TIFF/CMYK on request), Web-ready (JPEG/WebP, sRGB), and video (H.264/ProRes) per SOW.
7.5 Delivery method: secure download/gallery. File retention for delivered assets is 90 days; please back up upon receipt.
8) Intellectual Property & Usage License
8.1 Ownership: PLC (and/or the photographer/filmmaker) retains all copyrights to created works until otherwise assigned in writing.
8.2 License to Client: Upon full payment, Client receives a non-transferable, non-exclusive commercial license to use the final deliverables for the media, territories, and term specified in the SOW (e.g., website, organic social, paid ads, print, OOH; territory: global or specified; term: 12–36 months).
8.3 Exclusions: Any use outside the licensed scope (e.g., new channels, extended territories, additional term, sublicensing) requires a license upgrade.
8.4 Portfolio use: PLC may display work in our portfolio, Site, and social unless Client obtains a written embargo or NDA.
8.5 Third-party rights: Licensing of models/talent, music, fonts, and locations is separate and governed by third-party terms.
9) Quality & Acceptance
9.1 Work is deemed accepted upon (a) Client’s written approval, or (b) 7 days after delivery without written, specific notes against the SOW.
9.2 Any defects arising from downstream processing (e.g., color shifts in third-party printing/ad platforms) are outside our control.
10) Confidentiality & Data
10.1 Each party agrees to keep confidential business, product, and creative information disclosed during the Project.
10.2 PLC follows reasonable industry practices to protect data; however, no method is 100% secure.
11) Liability & Indemnity
11.1 PLC will exercise due care in handling products and files. Our total liability for any claim is limited to the amount paid for the affected portion of services or, at PLC’s option, a reshoot.
11.2 Client indemnifies PLC against claims arising from provided products, directions, or materials (e.g., IP, safety, regulatory compliance).
12) Force Majeure
12.1 PLC is not liable for delays or non-performance caused by events beyond reasonable control, including but not limited to extreme weather, natural disasters, government actions, strikes, outages, or transport failures. We will notify Client promptly and reschedule in good faith.
13) Governing Law & Disputes
13.1 These Terms are governed by the laws of Indonesia. Any dispute will be brought in the courts of Bali, Indonesia, unless both parties agree to arbitration or another forum.
14) General
14.1 If any provision is held unenforceable, the remainder remains in effect.
14.2 These Terms, together with the SOW and invoices, constitute the entire agreement and supersede prior discussions.
14.3 PLC may update these Terms on the Site; updates apply to future Projects.
